Welcome to the Intellum.com, Exceedlms.com and Rollbook.com web sites (“Web Sites”) operated by Intellum, Inc. (“Intellum” or “we” or “us” or “our”). We understand that you may be concerned about our collection, use, and disclosure of your information. Accordingly, we have implemented this Privacy Policy (“Policy”) to describe the types of information that we collect, what we do with it, how we protect it, and when we disclose it to third parties. This Policy is a part of and subject to the Terms of Service (“TOS”). Accordingly, when you enter into the TOS, you agree that you have read, understand, and agree that we can collect, use, and disclose your information in accordance with this Policy. If you do not agree or are not comfortable with any part of this Policy, you should not agree to the TOS (including this Policy) and you may not use the Web Sites.

Information Gathering and Usage

The following types of user information (“Information”) are gathered:

- Personal Information. If signing up for an Exceed Account as the account owner, we collect information that can be used to identify you personally (“Personal Information”), such as your name, mailing address, email address, billing information, etc. We also collect Personal Information provided to us via any emails you send to us and via any user information added by you to your Exceed account (including Personal Information for users other than yourself).
- Browsing Information. We collect information about your computer hardware and software and browsing activity.
- Training Information. We collect information on learning/training activities within the Learning Management System (“LMS”)
- Survey Information. We collect responses to any Intellum-sponsored Web Site surveys.

We collect this Information for the following general purposes: products and services provisioning, billing, identification and authentication, Web Site improvement, contact, and research.

Intellum may disclose Information (including Personal Information) under special circumstances, such as to comply with subpoenas or when your actions violate the Terms of Service. Generally speaking, we will not disclose your personal information to third parties who are not our affiliates without your consent. (We will, however, share your personal information with our affiliates.) However, we reserve the right to disclose your personal information without your consent for any of the following reasons:

Disclosure to Successors. We may disclose your personal information to any actual or potential successor-in-interest of ours, such as a company that is seeking to acquire us or the Web Site(s).

Third-Party Service Providers. We may disclose your personal information to third-party service providers who help us provide or maintain the Web Site. These companies may collect information about your domain type, IP address, and clickstream information. We require by contract that these third-party service providers implement and maintain reasonable practices to protect your personal information.

- Cookies are bits of electronic information that a web site can transfer to a visitor’s hard drive to help tailor and keep records of his or her visit. - Cookies are required to use the Exceed service. - We use cookies to record current session information, but do not use permanent cookies. You are required to log-in to your Exceed account after a certain period of time has elapsed to protect you against others accidentally accessing your account contents.

Data Storage

Intellum uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Websites. Although Intellum owns the code, databases, and all rights to the Websites, you retain all rights to your data.

Reviewing and Changing My Personal Information

We endeavor to keep our customer records complete and accurate. If your personal information has changed, if you believe that we have incorrect personal information about you, or if you simply want to review your personal information for accuracy, please access your profile and follow the instructions for reviewing and updating information.

Protecting Personal Information

Whenever we obtain your personal information, we will implement and maintain reasonable practices to protect your personal information from unauthorized access or disclosure. While we will use such efforts, we cannot and will not act as insurers of the security of your personal information. Accordingly, we assume no liability for any disclosure of data due to errors in transmission, unauthorized third-party access or other acts of third parties, or acts or omissions beyond our reasonable control.

Intellum may periodically update this Policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your Exceed primary account holder account or by placing a prominent notice on our site.
